1. Scope and Conclusion of Contract

These Terms and Conditions (T&Cs) apply to all contracts for online mixing and mastering services concluded between Barbreshift GmbH (Landstraße 142, 4020 Linz, represented by Verena Fischer, share capital 35,000 €) and the client. A contract is established when the client submits a binding order via the website or by email to [email protected] and we confirm this order.

2. Services and Order Process

The subject of the contract is the provision of audio post-production (Mixing, Mastering, Vocal Tuning). The client shall provide the necessary files (Stems/Wave files). To ensure optimal quality, these files must have a minimum sample rate of 44,100 Hz and a bit depth of at least 24 bits, with sufficient headroom (no clipping). 3. Pricing, Taxes, and Payment Terms

All prices listed on the website include the statutory VAT of 20%. Billing is based on the selected service (see Services).

Payment Modalities:

  • Deposit: A deposit of 50% of the total amount is required to secure the production slot.
  • B2B Payments: For business customers, a payment term of 14 days from the date of invoice applies.
  • Rush Fee: For requested express delivery, a surcharge of 30% on the standard price will be applied.

4. Project Workflow and Revisions

The average delivery time is 7 working days starting from the receipt of all correct files and the deposit payment. Each service includes a maximum of 3 revision rounds. Additional revision hours will be billed separately based on actual effort (see price list).

We store project data for a period of 6 months after the completion of the order. After this period, files will be permanently deleted unless otherwise agreed in writing.

5. Copyright and Usage Rights

The client warrants that they possess all necessary rights to the submitted materials (samples, vocals, compositions). Barbreshift GmbH acquires no rights to the work through the processing. All copyrights and exploitation rights remain with the client. We commit to absolute confidentiality regarding unpublished material, as detailed in our Privacy Policy.

6. Liability and Warranty

We commit to performing the work with professional diligence and care. As audio production is an artistic process, no specific aesthetic result can be guaranteed. Liability for slight negligence is excluded to the extent permitted by law. The client is solely responsible for backing up original files.

7. Right of Withdrawal and Cancellation

In accordance with the Fern- und Auswärtsgeschäfte-Gesetz (FAGG), the right of withdrawal for consumers expires once the service has been fully performed or if the execution began with the express consent of the client before the end of the withdrawal period. Cancellation before the start of work is possible; however, deposits may be retained in the event of a short-term cancellation.

8. Final Provisions

These Terms and Conditions are governed by the laws of the Republic of Austria. The place of jurisdiction for all disputes arising from this contract is Linz. Should any individual provision be invalid, the remainder of the contract remains unaffected.
